USE OF THE LUCKYPE PLATFORM
Use of the LuckyPe Platform / LuckyPe Services
Please read these Terms and Conditions (“T&Cs”) carefully before registering on, accessing, browsing, downloading, or using the LuckyPe website or app (collectively, the “LuckyPe Platform”), operated by Luckype India Private Limited, having its registered office at [Registered Address] (hereinafter “LuckyPe” or “we”). These T&Cs apply to all LuckyPe Services offered on the LuckyPe Platform, including, but not limited to, mobile recharge, bill payment, digital products, wallet services, marketplace services, and any other services provided by LuckyPe. By accessing or using the LuckyPe Platform or Services, you agree to these T&Cs.
Acceptance
By registering on, accessing, browsing, or using the LuckyPe Platform or availing any LuckyPe Service, you agree to be bound by these T&Cs and any service-specific terms. Accepting these T&Cs forms a legal contract between you and LuckyPe. If you do not agree, you must not use the LuckyPe Platform or Services. LuckyPe grants you a limited, non-exclusive, non-transferable, revocable right to access and use the Platform and Services, subject to your compliance with these T&Cs.
Eligibility
LuckyPe Services are available only to individuals aged 18 or above and not previously suspended or removed by LuckyPe. By using the Services, you confirm you meet these criteria and have the legal authority to enter into this Agreement. You shall not impersonate others or provide false information. LuckyPe reserves the right to suspend or terminate accounts in case of violations.
SSOID Service and Participating Platforms
LuckyPe’s Single Sign-On ID (SSOID) service allows users to register once and access all participating platforms linked with LuckyPe using a single login. Users must provide accurate information during registration and keep login credentials secure. Sharing login credentials or using another person’s account is prohibited. Users must immediately notify LuckyPe of any unauthorized use or security breach. LuckyPe reserves the right to reject registrations at its discretion.
Communication Policy
By using LuckyPe Services, you consent to receive alerts, notifications, promotional messages via SMS, email, push notifications, or calls. LuckyPe may share your information with third parties for marketing purposes. LuckyPe is not liable for delayed or non-delivery of messages due to network or device issues.
Digital Services and Bill Payments
LuckyPe offers digital services such as mobile/DTH recharge, bill payments, movie, bus, flight, and hotel bookings, coupon redemptions, and other digital products. Convenience fees may apply to certain transactions, such as wallet top-ups or third-party payment facilitation.
Prohibited Conduct
By using LuckyPe, you agree not to:
Violate these T&Cs or applicable laws.
Use the platform fraudulently or with misrepresented funds.
Infringe intellectual property or privacy rights.
Transmit offensive, obscene, or illegal content.
Circumvent security features or access another user’s account.
Reverse-engineer, decompile, or disrupt the Platform.
Termination and Violations
LuckyPe may suspend or terminate your account at any time for violations, fraudulent activity, or at its discretion, without prior notice. Upon termination, you must stop using LuckyPe Services.
Limitation of Liability
LuckyPe and its partners shall not be liable for indirect, incidental, or consequential damages, including lost profits or data loss, arising from use of the Platform or Services. Liability is limited to the amount paid, if any, for the relevant Service, or up to ₹5,000, whichever is lower.
Indemnification
You agree to indemnify and hold LuckyPe, its affiliates, employees, and partners harmless from any claims, losses, or damages arising from your misuse of the Platform or violation of these T&Cs.
Disclaimer and No Warranties
Services are provided “as is” without warranties of any kind. LuckyPe is not responsible for third-party services or content, network failures, or errors. Users assume full responsibility for the use of the Platform.
Ownership and Intellectual Property
All content, software, trademarks, and materials on the LuckyPe Platform are owned by LuckyPe or its licensors. Unauthorized use, reproduction, or distribution is prohibited. Suggestions or ideas shared with LuckyPe become the property of LuckyPe.
Modification of Terms
LuckyPe may update or modify these T&Cs at any time by posting the revised version on the Platform. Continued use constitutes acceptance of the changes.
Governing Law and Dispute Resolution
These T&Cs are governed by Indian law. Disputes shall first attempt to be resolved amicably, failing which they will be resolved via arbitration in New Delhi under the Indian Arbitration & Conciliation Act, 1996. Courts in New Delhi have jurisdiction for legal proceedings.
Severability and Survival
If any provision is found invalid or unenforceable, the remaining provisions remain effective. Provisions meant to survive termination will continue post-termination.
Entire Agreement
These T&Cs constitute the complete agreement between you and LuckyPe regarding use of the Platform and Services.
